1. Introduction and Acceptance of Terms

Welcome to AskBibleVerse. These Terms of Service ("Terms") constitute a legally binding agreement between you and AskBibleVerse ("we," "us," or "our") governing your access to and use of the AskBibleVerse website, mobile application, and any related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, please do not access or use the Service.

We may modify these Terms at any time. Your continued use of the Service following any changes indicates your acceptance of the modified Terms.

2. Description of Service

AskBibleVerse is a digital platform that provides Bible study tools and resources, including but not limited to:

  • Access to multiple Bible translations
  • AI-powered Bible question and answer functionality
  • Personalized Bible study plans
  • Note-taking features associated with Bible passages
  • Cross-device synchronization of user data

We reserve the right to change, suspend, or discontinue any aspect of the Service at any time without notice.

3. User Accounts and Eligibility

To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Eligibility: The Service is intended for users who are at least 13 years of age. If you are under the age of 13, you are not permitted to use the Service or provide us with personal information. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with these Terms or if we suspect misuse.

4. User Conduct and Acceptable Use

When using the Service, you agree not to:

  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using the Service to train machine learning models without our express written consent

  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

5. Intellectual Property Rights

The Service and all its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by AskBibleVerse and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use.

User Content: You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in connection with operating, providing, and improving the Service.

You represent and warrant that: (i) you own the User Content or have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you hereby grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use and incorporate such Feedback into the Service or any other products or services without any obligation or compensation to you.

6. Copyright Infringement (DMCA Policy)

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.

If you are a copyright owner or an agent thereof and believe that any content on the Service infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address;

Failure to comply with all of the requirements of this section may render your DMCA notice invalid.

We reserve the right to remove User Content alleged to be infringing without prior notice and at our sole discretion. In appropriate circumstances, we will also terminate a user's account if the user is determined to be a repeat infringer.

7. Payment Terms

AskBibleVerse may offer both free and premium services. If you choose to purchase premium features:

  • You agree to pay all fees and charges associated with your account on a timely basis and according to the pricing and billing terms in effect at the time of your purchase
  • All payments are processed through third-party payment processors. We do not store your payment card details.
  • All payments are non-refundable except as expressly set forth in these Terms or as required by applicable law
  • You authorize us (or our third-party payment processor) to charge your designated payment method for all purchases you make
  • Subscriptions will automatically renew for the same subscription period unless canceled before the renewal date. We will notify you before your subscription renews.
  • You can cancel your subscription at any time through your account settings or by contacting us. Cancellation will be effective at the end of the current billing cycle.

We reserve the right to change our pricing terms at any time, and such changes will be effective upon posting to the Service or otherwise notifying you.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by AskBibleVerse. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that AskBibleVerse shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

9. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THAT THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASKBIBLEVERSE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE.

UNDER NO CIRCUMSTANCES WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF $100 USD OR THE AMOUNT PAID BY YOU TO ASKBIBLEVERSE FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to defend, indemnify, and hold harmless AskBibleVerse, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Dispute Resolution

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and shall take place in \[Your City, State\]. 14. Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

16. Force Majeure

AskBibleVerse shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond AskBibleVerse's reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including "line-noise" interference), acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18. Miscellaneous

Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver: The failure of AskBibleVerse to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of AskBibleVerse.

Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by AskBibleVerse without restriction.

Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AskBibleVerse regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and AskBibleVerse.
